Flowave Terms of Service (End User License Agreement)

Service Provider: 2idiots (hereinafter referred to as "Company" or "We")
Welcome to the Flowave mobile application. This application is developed and operated by 2idiots.
These Terms of Service (hereinafter referred to as "these Terms") govern the rights, obligations, and responsibilities arising between the Company and you (hereinafter referred to as "End User" or "You") in connection with the use of the mobile application "Flowave" (hereinafter referred to as "the Application" or "the Service"). By downloading, installing, using, subscribing to, or making in-app purchases within the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms and the Company's Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not use the Service and must delete the Application.
IMPORTANT: Provisions Regarding the End User License Agreement Relationship with Apple
1. Acknowledgement of Parties:
You and We acknowledge that these Terms are concluded between You and Us only, and not with Apple Inc. (hereinafter referred to as "Apple"). You and We acknowledge that We, not Apple, are solely responsible for the Application and the content thereof. Your use of the Application must be consistent with the Usage Rules set forth in the Apple Media Services Terms and Conditions as of the Effective Date. You acknowledge that you have had the opportunity to review those Apple Media Services Terms and Conditions.
2. Scope of License:
The license granted to You for the Application is limited to a non-transferable license to use the Application on any Apple-branded products that You own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
3. Maintenance and Support:
You and We acknowledge that We are solely responsible for providing any maintenance and support services with respect to the Application as specified in these Terms or as required under applicable law. You and We acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
4. Warranty:
You and We acknowledge that We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. These Terms must provide that in the event of any failure of the Application to conform to any applicable warranty, the End User may notify Apple, and Apple will refund the purchase price for the Application to that End User. And to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Our sole responsibility.
5. Product Claims:
You and We acknowledge that We, not Apple, are responsible for addressing any claims of the End User or any third party relating to the Application or the End User’s possession and/or use of that Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation, including in connection with Your licensed Application’s use of the HealthKit and HomeKit frameworks. These Terms may not limit Our liability to Your End Users beyond what is permitted by applicable law.
6. Intellectual Property Rights:
You and We acknowledge that in the event of any third-party claim that the Application or the End User’s possession and use of that Application infringes that third party’s intellectual property rights, We, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
